Article 1. Applicability
1.1 Unless explicitly agreed otherwise, these RMA Terms and Conditions apply to all offers, contracts of purchase and sale, and deliveries of all goods and services, which are put on the market and/or provided by Lama Plus, s.r.o, hereinafter also referred to as Seller. The other party will be further referred to as Buyer.
1.2 These RMA Terms and Conditions include an RMA procedure arrangement for incorrect orders and wrong deliveries (Article 2) and defective products (Article 3).
Article 2. Incorrect order and wrong delivery
2.1. The Buyer is obligated to check the delivered goods on the same day after receiving of the goods from the Seller and the next day make a complaint by the Seller.
2.2 As soon as you find a difference in the quantity or type of goods among the data in the delivery note and the actual delivered goods, enter, please, the new complaint at www.lamaplus.com, section "Your profile" - Claims - New claim. Search according to the offer the necessary goods and choose the concrete invoice. Your complaint will be registered under RMA number. Our Salesperson will contact you for further advice.
2.3. Products for which an RMA number has been issued due to wrong delivery by the Seller shall be collected by Seller's carrier. The products that are returned to the Seller without an RMA number.
2.4. The products to be returned must be readily marketable and saleable as new, in undamaged and original packaging, unopened and without broken seals. Ordered products, which are combined or adjusted at the request of Buyer can never be returned.
2.5. A credit note shall be issued within 14 working days after the products have been received and checked.
Article 3. Defect Products
3.1. The Buyer can claim only the goods purchased from LAMA Plus. The Buyer sends the complained goods at his own expenses to the address of the company: LAMA Plus s.r.o, Svatopluka Čecha 706, 735 06 Karviná - Nové Město to control. The consignment and goods have to be also marked with the RMA number.
The complaint also enter at www.lamaplus.com, section Your profile - New claim and specify the discrepancies. Search according to the offer the necessary goods and choose the concrete invoice. Your complaint will be registered under RMA number. Our Salesperson will contact you for further advice.
3.2 The Seller uses the warranty period applied by the manufacturer for the products delivered. The Seller shall, on demand, make available the warranty terms applied by the manufacturer.
3.3. The Buyer can not rely on the warranty provisions if:
a) the Buyer has neglected the products;
b) the Buyer has made changes to the products or has had those made, which includes repairs that have not been performed by or on behalf of the Seller or the manufacturer;
c) the Buyer has treated the products without due care and attention in any other way.
3.4. After receipt of the defective goods, the Seller shall check them according to the standards of the concerned manufacturer. If on checking it appears that the products do not meet these standards, the Seller shall reserve the right to destroy the products and no credit note shall be issued. The Buyer shall receive a written notice of this. Returns shall be refused in the following cases:
The returned product is completely used up;
The warranty date of the return product has expired;
The returned product has not been used;
The returned product is not an original product;
3.5. The Buyer is obligated to deliver goods to the Seller in the original packaging. To make a complaint is necessary to send with goods relevant documents (manuals, installation diskettes, cables, etc.) and mark the shipment with the RMA number. The Buyer assumes full responsibility for the damage of the goods incurred during transport to the Seller.
3.6 If the claimed goods are print media, it is necessary to send a print sample that shows the defect. In case of suspected damage to the device by non-original cartridges, it must be accompanied by expressions technician that the failure was caused by the use of the cartridge, as well as send used cartridges, copy and devalued piece of equipment.
3.7.The Buyer is obligated to send to the Seller RMA No., management list and Flash Report (for claims of Canon toner ).
3.8. Complaints will be processed within 30 days.
Article 4. Procedure of the complaint found out within receipt of the consignment from a carrier
4.1. The Buyer is obligated to check the delivered goods on the same day after receiving of the goods from the Seller and the next day make a complaint by the Seller.
4.2. If there are any visible damages of packages, pallets or there are any visible partial losses of a consignment indoor, during the transport of goods, is necessary before taking over of the goods to write with carrier a record about damaged goods, either in the CMR or in the delivery note of the carrier, reservation about the damage.
4.3. Another necessary information to make a complaint by the Seller:
- order No. of items
- delivery note No.
- detailed description of complaints + photos
- number of damaged goods
- suggestions to settle a claim
4.4. All the complaints have to be made in a written form
These documents have to be sent by e-mail of fax to the Seller.
4.5. In case that one of these claim requirements is not met, the claim will not be accepted.
4.6. The Seller will settle the claim by the carrier.
4.7 Complaint of non-visible defects must be announced to the Seller within 24 hours.
4.8 Complaints will be settled by default within 30 days.
All complaints and disputes arising from claims have to be solved in accordance with applicable laws, especially by the Commercial Code, § 422 to 441. We reserve the right to change the RMA terms and conditions without notice.
Only the goods purchased at LAMA Plus can be claimed in our company.
Each claim has to be announced to your Salesperson, as well as register at www.lamaplus.com in section: Your profile / Claims / New claim
